Nutzungsbedingungen für Verbraucher

Für die Nutzung der bereitgestellten Schuhgrößenempfehlung gelten ausschließlich die nachfolgenden Nutzungsbedingungen der Footprint Technologies GmbH, Alt-Stralau 5B, 10245 Berlin (nachfolgend als „Footprint Technologies“ bezeichnet).

§ 1 Gegenstand

Basis für die Schuhgrößenempfehlung ist die Smartphone-basierte Fußmessung, die Nutzer selbst durchführen können (sog. Fußvermessungstechnologie), sowie die in einer Datenbank von Footprint Technologies gesicherten Fuß- und Schuhmessdaten. In der Datenbank sind die Schuhmessdaten verschiedener Hersteller gespeichert. Bei jeder Schuhgrößenempfehlung wird individuell für die gemessenen Füße und das jeweils favorisierte Schuhmodell eine Größenempfehlung erstellt.
Footprint Technologies bietet seine Dienstleistung zur Schuhgrößenempfehlung derzeit ausschließlich für Schuhe ausgewählter Hersteller an. Die Schuhgrößenempfehlung ist dabei nur für aktuelle Schuhmodelle möglich, bei denen die Schuhmessdaten in der Datenbank von Footprint Technologies gespeichert sind. Footprint Technologies ist bemüht, die Datenbank ständig zu erweitern, um die Schuhgrößenempfehlung auch für neue Schuhmodelle anbieten zu können.
Die Schuhgrößenempfehlung ist für den Nutzer kostenlos. Der Nutzer kann die Schuhgrößenempfehlung ohne Kundenkonto durchführen. Als nicht registrierter Nutzer kann der Nutzer während des andauernden Kaufvorgangs auf die Ergebnisse der Schuhgrößenempfehlung zugreifen. Diese Ergebnisse der Schuhgrößenempfehlung werden für die Dauer des jeweiligen Kaufvorgangs lokal auf dem Endgerät zwischengespeichert.

§ 2 Nutzung der Schuhgrößenempfehlung

Die von Footprint bereitgestellte Schuhgrößenempfehlung richtet sich ausschließlich an Verbraucher. Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können.
Um die Schuhgrößenempfehlung nutzen zu dürfen, muss der Nutzer mindestens 16 Jahre alt sein.
Ohne Nutzerkonto kann der Nutzer im Rahmen eines Kaufvorgangs auf die zwischengespeicherten Schuhgrößenempfehlung zugreifen. In diesem Fall werden die Ergebnisse der Schuhgrößenempfehlung auf dem Endgerät zwischengespeichert und können jederzeit durch Löschen des Zwischenspeichers vom Endgerät entfernt werden.

§ 5 Durchführung der Fußmessung

Die entwickelte Softwarelösung ermöglicht eine einfache Vermessung der eigenen Füße oder die Füße einer anderen Person, mittels eines genormten Blattes Papier und einer Smartphone Kamera, ohne dass dafür die Installation einer App erforderlich ist.
Der Nutzer wird von Footprint Technologies Schritt für Schritt durch die Fußmessung angeleitet. Um dem Nutzer mittels der Schuhgrößenempfehlung das von ihm favorisierte Schuhmodell in der passenden Größe empfehlen zu können, ist eine genaue Befolgung der von Footprint Technologies bereitgestellten Schritt für Schritt Anleitung erforderlich.
Im Falle der Vermessung von Kindern versichert der Nutzer, dass er als Erziehungsberechtigter oder infolge einer vom Erziehungsberechtigten für diesen Zweck erteilten Einwilligung, zur Durchführung der Fußmessung an dem Kind berechtigt ist und insbesondere keine Rechte Dritter, wie beispielsweise Persönlichkeitsrechte verletzt.
Bei der Durchführung der Fußmessung mittels der Smartphonekamera ist der Nutzer dafür verantwortlich, dass in dem Video ausschließlich die Füße erkennbar sind. Das Video darf insbesondere keine Gesichter enthalten.

§ 6 Analyse und Verwendung der Daten

Die ermittelten Fußdaten werden mit der Schuhdatenbank von Footprint Technologies abgeglichen. Auf Basis dieses Datenabgleichs wird mit Hilfe eines Algorithmus die herstellerspezifische und schuhmodellbezogene passende Schuhgröße ermittelt (sog. Matching-Vorgang).
Footprint Technologies analysiert und verwendet die Daten der Fußmessung, um dem Nutzer die passende Schuhgröße für ein konkretes Schuhmodell empfehlen zu können. Dazu speichert Footprint Technologies die vom Nutzer aufgenommene Bildsequenz des Fußes und wertet dieses mit Hilfe des Matching-Algorithmus aus.
Die Analyse und Verwendung von Daten erfolgt dabei ausdrücklich mit nicht persönlichen Daten. Das Ergebnis der Analyse wird verwendet, um
dem Nutzer die passende Schuhgröße für ein bestimmtes Schuhmodell empfehlen zu können,
die Datenbank der Footprint Technologies, die als Grundlage für die Schuhgrößenempfehlung dient, verbessern und erweitern zu können,
die Online-Shops mit Hilfe der analysierten Daten bei der Reduzierung der Retourenquote zu unterstützen,
die Hersteller zu unterstützen, ihre Schuhe und die herstellereigenen Größenangaben zu optimieren,
Beratungs- und Analysedienstleitungen anbieten zu können,
dem Nutzer ein alternatives Schuhmodell empfehlen zu können, falls das gewünschte Schuhmodell nicht in der passenden Größe verfügbar ist oder ein anderes Schuhmodell nach Auswertung der Schuhgrößenempfehlung besser passt. Die Empfehlung erfolgt entweder auf Basis des Empfehlungssystems des Shops oder auf Grundlage des eigenen Empfehlungssystems von Footprint Technologies.
Footprint Technologies ist berechtigt, die anonymen Daten der Schuhgrößenempfehlung
zu bearbeiten,
für die hier festgelegten Zwecke der Optimierung der Schuhpassform, Beratungsdienstleistungen diesbezüglich insbesondere auch kommerziell zu verwenden,
für Forschungszwecke zu verwenden und zu analysieren,
in anonymisierter Form an Dritte weiterzugeben.

Die Daten der Schuhgrößenempfehlung umfassen die Daten der Fußmessung und die vom Nutzer aufgenommenen Schnappschüsse der Füße.

Bei einer Weitergabe von Daten wird Footprint Technologies die Daten des Nutzers Dritten nur in anonymisierter Form zur Verfügung stellen.

§ 7 Datenschutz

Sofern der Nutzer in eine Analyse der personenbezogenen Daten eingewilligt hat, kann der Nutzer einer Verarbeitung seiner Daten jederzeit widersprechen. In diesem Fall werden die personenbezogenen Daten nicht weiter analysiert und gesammelte Daten gelöscht, sofern für diese Daten nicht eine gesetzliche Aufbewahrungspflicht besteht.
Die Einzelheiten zum Datenschutz sind in der Datenschutzerklärung enthalten.

§ 8 Haftung

Die Haftung beider Parteien ist unbeschränkt im Falle von Vorsatz, grober Fahrlässigkeit und Verletzung des Lebens, Körpers oder der Gesundheit sowie im Falle der vorsätzlichen oder fahrlässigen Verletzung von vertragswesentlichen Pflichten (Kardinalpflichten). Vertragswesentlich sind solche Pflichten, deren Erfüllung die ordnungsgemäße Vertragsdurchführung erst ermöglicht. Im Falle einer fahrlässigen Verletzung vertragswesentlicher Pflichten ist die Haftung von Footprint Technologies auf den typischen, vorhersehbaren Schaden beschränkt. Daneben haftet Footprint Technologies unbeschränkt nach dem Produkthaftungsgesetz.
Die Einschränkungen in Abs. 1 gelten auch für die gesetzlichen Vertreter und Erfüllungsgehilfen der Parteien.
Abgesehen von denen in Abs. 1 genannten Fällen, ist jegliche weitere Haftung von Footprint Technologies ausgeschlossen.
Bei der Schuhgrößenempfehlung handelt es um keine orthopädische oder medizinische Empfehlung, sondern um eine Empfehlung, die auf einem Abgleich zwischen den Fußmessdaten und den Schuhmessdaten beruht. Die Schuhgrößenempfehlung hängt von der richtigen Durchführung der Fußmessung durch den Nutzer sowie vom individuellen Tragegefühl ab. Daher gewährt Footprint Technologie nicht, dass die Schuhgrößenempfehlung korrekt ist. Es ist Aufgabe des Nutzers, den ausgewählten Schuh auf eine geeignete Passform zu überprüfen.

§ 10 Schlussbestimmungen

Sollte eine der vorstehenden Bestimmungen unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen dieses Vertrages unberührt. Die Parteien werden in einem solchen Fall die unwirksame Bestimmung durch eine Regelung ersetzen, die dem wirtschaftlichen Zweck der zu ersetzenden Bestimmung möglichst nahekommt. Entsprechendes gilt für Regelungslücken.
Soweit nicht zwingende gesetzliche Bestimmungen nach dem Heimatrecht des Nutzers entgegenstehen, gilt deutsches Recht unter Ausschluss des UN-Kaufrechts.
Footprint Technologies behält sich das Recht vor, im Falle einer technischen Weiterentwicklung der Softwarelösung oder einer Gesetzesänderung, diese Nutzungsbedingungen zu modifizieren und diese der technischen und rechtlichen Entwicklung anzupassen.
Die EU-Kommission hat eine Internetplattform zur Online-Beilegung von Streitigkeiten geschaffen. Die Plattform dient als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten betreffend vertragliche Verpflichtungen, die aus Online-Kaufverträgen erwachsen. Nähere Informationen sind unter dem folgenden Link verfügbar: http://ec.europa.eu/consumers/odr. Zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle ist Footprint Technologies weder bereit noch verpflichtet.

Terms of use for consumers

The following terms of use of Footprint Technologies GmbH, Alt-Stralau 5B, 10245 Berlin (hereinafter referred to as “Footprint Technologies”) apply exclusively to the use of the shoe size recommendation provided.

§ 1 Subject matter

The basis for the shoe size recommendation is the smartphone-based foot measurement, which users can carry out themselves (so-called foot measurement technology), as well as the foot and shoe measurement data saved in a database of Footprint Technologies . The database stores shoe measurement data from various manufacturers. For each shoe size recommendation, a size recommendation is created individually for the measured feet and the respective favoured shoe model.
Footprint Technologies currently offers its shoe size recommendation service exclusively for shoes from selected manufacturers. Shoe size recommendation is only possible for current shoe models for which the shoe measurement data is stored in the Footprint Technologies database. Footprint Technologies is constantly working to expand the database in order to be able to offer shoe size recommendations for new shoe models.
The shoe size recommendation is free of charge for the user. The user can carry out the shoe size recommendation without a customer account. As a non-registered user, the user can access the results of the shoe size recommendation during the ongoing purchase process. These results of the shoe size recommendation are temporarily stored locally on the end device for the duration of the respective purchase process.

§ 2 Use of the shoe size recommendation

The shoe size recommendation provided by Footprint is intended exclusively for consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
To use the shoe size recommendation, the user must be at least 16 years old.
Without a user account, the user can access the cached shoe size recommendation as part of a purchase process. In this case, the results of the shoe size recommendation are cached on the terminal device and can be removed from the terminal device at any time by deleting the cache.

§ 5 Performance of the foot measurement

The software solution developed enables simple measurement of one’s own feet or the feet of another person, using a standardised sheet of paper and a smartphone camera, without the need to install an app.
Footprint Technologies guides the user step by step through the foot measurement process. In order to be able to recommend the user’s favourite shoe model in the appropriate size by means of the shoe size recommendation, it is necessary to follow the step-by-step instructions provided by Footprint Technologies exactly.
In the case of the measurement of children, the user assures that he/she is authorised to carry out the foot measurement on the child as the legal guardian or as a result of consent granted by the legal guardian for this purpose and, in particular, that he/she does not violate any rights of third parties, such as personal rights.
When taking foot measurements using the smartphone camera, the user is responsible for ensuring that only the feet are recognisable in the video. In particular, the video must not contain any faces.

§ 6 Analysis and use of data

The determined foot data is compared with the Footprint Technologies shoe database. Based on this data comparison, an algorithm is used to determine the manufacturer-specific and shoe-model-related matching shoe size (so-called matching process).
Footprint Technologies analyses and uses the data from the foot measurement to recommend the right shoe size for a specific shoe model to the user. To do this, Footprint Technologies stores the image sequence of the foot taken by the user and evaluates it with the help of the matching algorithm.
The analysis and use of data is done explicitly with non-personal data. The result of the analysis is used to
to be able to recommend the user the appropriate shoe size for a particular shoe model,
to be able to improve and expand the Footprint Technologies database, which serves as the basis for shoe size recommendation,
to support online shops in reducing the returns rate with the help of the analysed data,
support manufacturers to optimise their footwear and the manufacturers’ own size specifications,
to be able to offer advisory and analytical services,
to be able to recommend an alternative shoe model to the user in case the desired shoe model is not available in the matching size or another shoe model fits better after evaluating the shoe size recommendation. The recommendation is made either on the basis of the shop’s recommendation system or on the basis of Footprint Technologies’ own recommendation system.
Footprint Technologies is entitled to use the anonymous data of the shoe size recommendation
to edit,
to use for the purposes set out herein the optimisation of the shoe fit, advisory services in this respect in particular also commercially,
to use and analyse for research purposes,
to third parties in anonymised form.

The shoe size recommendation data includes the foot measurement data and the snapshots of the feet taken by the user.

In the event of data disclosure, Footprint Technologies will only make the user’s data available to third parties in anonymised form.

§ 7 Data protection

If the user has consented to an analysis of personal data, the user may object to the processing of his/her data at any time. In this case, the personal data will no longer be analysed and collected data will be deleted, unless there is a legal obligation to retain this data.
The details on data protection are contained in the privacy policy.

§ 8 Liability

The liability of both parties is unlimited in the event of intent, gross negligence and injury to life, body or health as well as in the event of intentional or negligent breach of material contractual obligations (cardinal obligations). Material contractual obligations are those obligations whose fulfilment makes the proper performance of the contract possible in the first place. In the event of a negligent breach of material contractual obligations, Footprint Technologies’ liability is limited to the typical, foreseeable damage. In addition, Footprint Technologies is liable without limitation under the Product Liability Act.
The restrictions in para. 1 also apply to the legal representatives and vicarious agents of the parties.
Apart from the cases mentioned in paragraph 1, any further liability of Footprint Technologies is excluded.
The shoe size recommendation is not an orthopaedic or medical recommendation, but a recommendation based on a comparison between the foot measurement data and the shoe measurement data. The shoe size recommendation depends on the correct performance of the foot measurement by the user as well as the individual wearing experience. Therefore, Footprint Technology does not guarantee that the shoe size recommendation is correct. It is up to the user to check the selected shoe for a suitable fit.

§ 10 Final provisions

Should any of the above provisions be or become invalid, the validity of the remaining provisions of this contract shall remain unaffected. In such a case, the parties shall replace the invalid provision with a provision that comes as close as possible to the economic purpose of the provision to be replaced. The same applies to loopholes.
Unless mandatory statutory provisions under the user’s home law conflict with this, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
Footprint Technologies reserves the right to modify these Terms of Use in the event of technical development of the software solution or a change in the law and to adapt them to technical and legal developments.
The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Footprint Technologies is neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
